This roundtable discussion will explore some key clauses in offshore construction (including in particular exclusion clauses) in the light of recent case law, and look over the legal issues which commonly arise out of disputes concerning defective work, delay, and termination.
We are delighted that the discussions will be led Lucy Garrett and Calum Lamont of Keating Chambers. Lucy and Calum both have a large practice in energy and offshore project disputes, and are co-authors of the new textbook in the field, Keating on Offshore Construction and Marine Engineering (2015). Lucy represented the rig owner in Transocean v Providence [2014] EWHC 4260 (currently under appeal).
The roundtable discussion will primarily consist of scenarios and case studies which will be discussed and explored, including:
• Claims arising out of defective work, delay, and disputed terminations.
• The effect of different wording in different exclusion clauses (including consideration of the decision in Transocean v Providence)
• The courts’ approach to risk allocation in offshore contracts (including consideration of the recent Supreme Court decision in Arnold v Britton and others [2015] UKSC 36)
